Terms of Service

1. About the service

FastSell is a platform for automatically replying to comments and direct messages on Instagram Business accounts, capturing customer inquiries, and forwarding them to external systems.

The service is provided by INNOSOFT LLC (TIN 311752356).

2. Account and registration

Registration requires a valid phone number and accurate information. One account is created per business.

Keeping your login and password secure is your responsibility. All actions taken through your account are considered to be taken by you.

3. Your obligations

When using the platform you agree to the following:

• —The connected Instagram account belongs to you, or you have a lawful right to manage it.
• —You comply with Meta's platform policies (Instagram and Facebook).
• —You collect and use your customers' data on a lawful basis.
• —You do not use AI replies to offer false information, deception, or illegal goods.
• —You do not use the platform for spam or bulk unsolicited messaging.

4. AI key and costs

The platform does not provide AI tokens. You connect your own AI provider key (Google Gemini, Anthropic Claude, or OpenAI).

AI usage is billed directly to your account with that provider. We take no markup on those costs and are not responsible for the amount.

Outages, rate limits, an exhausted balance, or a revoked key on the provider's side may stop the service. Such cases fall outside our responsibility, though we will try to notify you promptly.

5. Plans and payment

The platform offers a free plan and paid plans. The limits of each plan are listed on the pricing page.

During the launch period all plans may be provided free of charge. We will give at least 30 days' notice before billing begins.

When a subscription expires, the account is temporarily suspended. Your data is retained for the period stated in the privacy policy.

We reserve the right to change prices. Changes take effect after the end of your current paid period.

6. Prohibited use

The following is prohibited and results in immediate suspension:

• —Reselling the platform to third parties or offering it as your own service (a separate agreement is required for this).
• —Technical attacks, excessive load through automated requests, or attempts to bypass security.
• —Attempting to access other users' data without authorization.
• —Using the platform for unlawful activity.

7. Meta-related limitations

The platform depends on Meta's APIs. If Meta changes its rules, revokes a permission, or introduces technical limits, parts of the service may change or stop working.

At Meta's request, or where a violation is identified, we may be required to suspend your account or specific features.

8. Downtime and liability

The service is provided "as is". We aim for uninterrupted operation, but temporary outages may occur due to maintenance, provider failures, or causes beyond our control.

We are not liable for indirect losses, lost profits, or damages caused by third-party services failing.

In any case, our liability does not exceed the subscription amount paid over the previous 3 months.

9. Intellectual property

The platform, its code, design, and brand belong to us. The data you enter (product catalogue, settings, leads) remains yours.

We may store and process your data to the extent necessary to provide the service.

10. Termination

You may delete your account at any time. Amounts paid for an unused period are not refunded unless otherwise agreed.

If these terms are breached, we may suspend the account with prior notice, or immediately in the case of serious violations.

11. Governing law

These terms are governed by the laws of the Republic of Uzbekistan. Disputes are resolved primarily through negotiation and, failing agreement, in the courts of the Republic of Uzbekistan.

12. Changes to these terms

These terms may be updated. We will give at least 14 days' notice of significant changes. Continuing to use the platform after such notice means you accept the new terms.
